No-fault divorce was enacted in New York on August 15, 2010. Prior to this, divorce in the state could only be accomplished through fault-based grounds, such as cruel and inhuman treatment, abandonment for a continuous time period of one year or more, adultery, imprisonment of one of the spouses for more than 3 years, or conversion of a separation agreement after living apart for one year or more. Even uncontested divorces had to be made on the basis of one of the fault-based grounds for divorce. With the passage of the no-fault divorce laws, married partners can now dissolve their marriages within 6 months after declaring that the marriage is irretrievably broken. This makes for a more streamlined legal process where spouses do not have to prove any wrongdoing to file for a divorce.
