What is a Separation Agreement?
A separation agreement consists of a detailed written contract between spouses which delineates how issues such as child custody, visitation rights, spousal support, division of marital property, and all other marital matters will be handled and arranged.
When the agreement is properly written, signed and notarized, it becomes a binding agreement that can be legally enforced if one of the spouses fails to comply with its terms.
A separation agreement can later be included in a divorce decree, in an uncontested action for divorce, saving extensive litigation costs.
